Paying a civil crew under an enterprise agreement (EBA) isn't just hours times rate. It's site allowances, travel, overtime, shift penalties, inclement weather and a dozen other rules, applied to the right person on the right day. Get it wrong and you're underpaying people, and since 2025 that can be a criminal matter. Here's what EBA payroll compliance looks like for civil contractors, and how to stop it going wrong.

The short answer

EBA payroll compliance means paying every worker exactly what their agreement says, for every hour, allowance and penalty, and keeping records that prove it. For civil contractors, the hard part isn't knowing the rules. It's applying them correctly to hours that come in from the field.

Why EBA payroll is harder in civil

Most payroll problems in civil don't start in the office. They start on site.

  • Every agreement is different. You might run one EBA for your own crews and pay others under the Building and Construction General On-site Award. Some contractors run several agreements at once.

  • Rates depend on what someone did, not just who they are. An operator might be on a different classification depending on the machine they ran that day.

  • Allowances depend on where the work happened. Site allowances, travel, fares and living away from home allowances all hinge on location.

  • Weather changes the pay. Inclement weather rules decide whether stood-down time is paid, and how.

  • Hours come in late and messy. Paper timesheets, texts and glovebox dockets reach the office days after the shift.

Where EBA payroll goes wrong

Most underpayments aren't deliberate. They come from small errors repeated every pay run.

The common mistakes:

  1. Missed allowances. Site, travel or meal allowances not applied because nobody recorded where the crew worked.

  2. Overtime calculated wrong. Daily and weekly overtime thresholds mixed up, or the wrong multiplier after the first two hours.

  3. Wrong classification. A worker paid at their base level when they ran higher-level plant.

  4. Inclement weather errors. Wet days paid as leave, or not paid at all, when the agreement says otherwise.

  5. Rate changes not applied. An EBA pay increase kicks in, but the payroll system is still on last year's rates.

  6. Manual re-entry. Hours keyed in twice, once from the timesheet and once into payroll, with errors each time.

  7. Super on the wrong earnings. Super paid on the base rate only, missing allowances and penalties that count as ordinary time earnings.

What the law expects

Under the Fair Work Act, you need to pay at least what the agreement or award says, and be able to prove it.

Records:

  • Time and wage records kept for 7 years

  • Hours worked, rates paid, allowances, penalties and overtime for each worker

  • Records that are accurate, legible and kept in English

Payslips:

  • Issued within one working day of payday

  • Showing the rates, hours, allowances and deductions

Underpayments:

  • Fines for underpayment can be large, and back pay is owed on top

  • Super is owed on ordinary time earnings, which can include some allowances and shift penalties, but generally not overtime

  • Since 1 July 2026, under Payday Super, super must be paid with each pay run, not quarterly

  • Since 1 January 2025, intentional underpayment of wages is a criminal offence

If an audit or a claim lands, you need to show the hours, the rule that applied, and what was paid. When that lives across paper timesheets and spreadsheets, it takes weeks. Good software makes it minutes.

What to look for in EBA payroll software

  1. EBA and award interpretation. Your actual agreement built into the system, so the rules are applied automatically, not worked out by hand.

  2. Timesheets from the field. Crews log hours on site, on their phone, on the day.

  3. Location and job data on every timesheet. So site and travel allowances apply correctly.

  4. Classification by task. Pay rates that follow the work and the plant, not just the person.

  5. Overtime and penalties calculated automatically. Daily, weekly, shift and weekend rules handled for you.

  6. Supervisor approval. Hours checked by the person who was there, before they reach payroll.

  7. Payroll integration. Approved hours flow into your payroll and accounting system without re-entry.

  8. A full audit trail. Every hour, every approval and every rule, on record.
